Draft for legal review · New Zealand
Draft — not yet in force
This page sets out the points that must be covered. Its wording must be drafted by a New Zealand lawyer before launch, particularly the business float and the voucher limit, which follow the advice on the financial service and anti-money-laundering exemptions.
Terms of Service
These terms cover use of the Elite Estate and Trade Rewards directory, the business portal, and the customer wallet. By creating an account you accept them.
Business accounts
- Subscriptions are billed monthly in advance, have a minimum term of six months, and are not refundable mid-period. Every business pays the same price for its plan.
- A listing appears publicly only once verified and paid.
- Anyone signed in to a business account can issue rewards and spend its float. Each action is attributed to the person who took it and logged.
- We may suspend a listing where verification fails, where fraud is suspected, or where a payment is charged back.
Reviews
- Only a customer who has received a reward from a business may review it.
- A reward may never be made conditional on leaving a review, or on a review being positive.
- Reviews may be moderated. On the Plus and Premium plans, reviews are shown on the business's profile and the business may respond once, publicly.
Credits and redemption
- 100 credits = NZ$1.00. Credits are a claim on Elite Estate and Trade Rewards, not legal tender, and cannot be transferred between customers.
- Credits do not expire.
- Newly issued credits are pending for a cooling period set by the issuing business — 3 days unless it chooses otherwise, between 1 and 30 days. During that window the business may reverse them, with a reason, and you will be told.
- Once available, credits may only be adjusted by us, and only with a recorded reason.
- Redemption is in $5.00 increments, minimum $5.00 and maximum $1,000.00 per transaction. Any remainder stays in your wallet and is never forfeited.
- Vouchers are issued by GiftPay and are subject to GiftPay's own terms.
- If a redemption fails, credits are returned to your wallet in full.
- A total of NZ$5,000.00 of vouchers may be issued to any one person. This limit applies across every business that has rewarded you and cannot be raised. Credits above it stay in your wallet and do not expire.
- Credits and vouchers cannot be exchanged for cash, by us or by anyone else.
- A voucher's value is set when it is issued. It cannot be topped up, reloaded or added to afterwards, and a new redemption always creates a new voucher.
- Vouchers may only be spent with retailers supplying goods and services. They cannot be used to buy financial products or services.
Business float
- Float is funded in advance by the business and used solely to issue credits.
- Card processing is charged at cost and shown itemised before payment.
- Float is a non-refundable pre-payment for gift vouchers. It does not expire and may be used to issue credits at any time, but it is not redeemable for cash and will not be paid back to the business.
- Float may never go negative. Where float is insufficient, issuance is declined.
- If a business cancels, credits already issued to customers are still honoured. Remaining float is held against that outstanding liability.
Privacy Policy
Elite Estate and Trade Rewards is a New Zealand service. We collect, hold, use and share personal information under the Privacy Act 2020 and its Information Privacy Principles.
What we collect
- Businesses — name, NZBN, GST number, trading address, contact details, verification documents, and payment details held by our payment provider.
- Customers — email, mobile, name, and credit and redemption history.
- Everyone — access logs, IP address and device information, kept for security and audit.
Where it is stored
Some of the providers we rely on — such as our payment processor — store data outside New Zealand. We only use providers that protect it to standards comparable with the Privacy Act. [List of providers and countries to be confirmed before launch.]
Privacy officer
Questions or requests about your personal information go to our privacy officer. [Name and contact address to be confirmed before launch.]
Details given to us by a business
A business may enter your email or mobile in order to send you credits. That means we hold your details before you have dealt with us directly.
- The first message we send you says which business provided your details.
- You can ask us to delete them at any time, whether or not you claim the credits.
- We do not use those details for marketing, and we do not pass them to anyone else.
This reflects our obligations when collecting information about you from someone else — Information Privacy Principle 3A of the Privacy Act 2020, in force from 1 May 2026.
Your privacy rights
- Access — ask for the personal information we hold about you, or download it from your account settings.
- Correction — ask us to correct anything that's wrong.
- Deletion — close your account and have your personal details removed. Financial records are kept for as long as the law requires, with identifying details anonymised.
- Complaint — raise it with us, and with the Office of the Privacy Commissioner if we don't resolve it.
If a privacy breach occurs that is likely to cause serious harm, we will notify you and the Privacy Commissioner as the Privacy Act requires.
